In this Privacy Statement (“Statement”), Provider describes the personally identifiable information of a natural person using the Services provided by the Customer to Provider (“PII”) that Provider collects through the Services, which for purposes of this Statement only includes, without limitation, all Provider websites associated with the Services. Unless expressly noted otherwise, this Statement applies to all of the Services as described in the Terms and Conditions. All terms not otherwise defined herein shall have the meanings set forth in the Terms and Conditions www.lucera.com/legal/terms-and-conditions-vendor/ and Service Offering www.lucera.com/legal/service-offering-vendor/.
What PII Does Provider Collect About Customer and Why?
The PII that Provider may collect from Customer allows Customer to register for Services, log into the Services, and allows Provider to make Services available. Provider may also use PII to personalize and continually improve the Services. Generally, Provider collects information about Customer and its natural person users directly from natural person users or their use of the Services.
When Customer creates an account with Provider, Provider may collect the following information, which may include PII:
- Natural person user’s first and last name;
- Natural person user’s email address and desired password;
- Natural person user’s mailing address; and
- Phone number for natural person users.
How Does Provider Use PII?
Provider may use the PII that Provider gathers for the following purposes:
- To provide the Services to Customer and for internal business purposes including, without limitation, billing, training, quality assurance, site administration and customer service;
- To provide information and other communications to Customer regarding the Services;
- To improve the Services;
- For research and product development purposes;
- To better understand how natural person users access and use the Services, both on an aggregated and individualized basis.
When and How Does Provider Share PII Provider Receives?
Provider may share PII as follows:
- Affiliates. Provider may disclose PII to Provider’s Affiliates; however, if Provider does so, such use and disclosure of the PII will be subject to this Statement.
- Sources. Provider may disclose PII to third party vendors, service providers, contractors or agents who perform functions on Provider’s behalf. (For example, these providers may help us administer the Services.) These third parties are generally required to maintain the confidentiality, security and integrity of information, and to only use such information for the purposes for which they have been engaged by Provider.
Provider also may share the PII as follows:
- Business Transfers. If Provider is acquired by or merged with another company, if substantially all of Provider’s assets are transferred to another company, or as part of a bankruptcy proceeding.
- In Response to Legal Process. To comply with the law, rule, regulation, a judicial proceeding, court order or other legal process, such as in response to a subpoena as well as in defense of Provider’s rights.
- Request of Source, Market or Authority. To Sources, Markets and Authorities.
Terms and Conditions
Customer’s use of Services, as well as any dispute over privacy, is subject to this Statement and Provider’s Terms and Conditions, including, without limitation, applicable limitations on damages and the resolution of disputes.
Consent to Transfer Information to the United States
Please note that PII Provider collects may be transferred to and processed in the United States. By using Services and Provider websites associated with the Services, Customer and its natural person users and any individuals with PII held by Customer consent to the transfer and processing of such information in the United States, which does not have data protection laws that provide the same level of protection that exists in countries in the European Economic Area, which such consent is voluntary. If, however, Customer or its natural person users do not consent, then Provider may not be able to provide Customer and/or such natural person users with Provider’s Services.
Changes to this Statement
Notwithstanding anything set forth in this Agreement, Provider may change this Statement from time to time, so be sure to check back periodically. Provider will post the revised Statement, at www.lucera.com/legal/privacy-statement-vendor/, and/or send it by e-mail. If Provider makes any changes to this Statement that materially affect Provider’s practices with regard to the PII Provider have previously collected from Customer, Provider will endeavor to provide Customer with notice in advance of such change, by highlighting the change on the Services or by sending an email to Customer at the email address that Customer has registered with Provider.
